						<section><p>Notwithstanding the provisions of &#xA7;&#xA0;<a class="law" title="Ground water withdrawal permits" href="/62.1-266/">62.1-266</a>, the <span class="dictionary">Board</span> shall <span class="dictionary">waive</span> the expiration of any <span class="dictionary">ground water withdrawal permit</span> for a well that serves exclusively residential users, is located in the Eastern Virginia Groundwater Management Area north of the Occoquan River, and is located within five miles of any commercial or industrial permitted ground water withdrawal until all such permitted withdrawals for commercial or industrial permitted wells within five miles of the subject residential well have been halted for five years. No sooner than five years after the termination of such commercial or industrial withdrawals, the <span class="dictionary">Department</span> shall assess whether the termination of the commercial or industrial withdrawals has substantially mitigated the stress upon the aquifer in proximity to the permitted residential well and redetermine whether the <span class="dictionary">ground water withdrawal permit</span> for the residential well shall be renewed.</p></section></text><history>2024, c. 768.</history><metadata></metadata></law>
