						<section><p>Any <span class="dictionary">permittee</span> or <span class="dictionary">party</span> aggrieved by (i) a <span class="dictionary">permit</span> or <span class="dictionary">permit</span> enforcement decision of the <span class="dictionary">Board</span> under this article or (ii) a decision of the <span class="dictionary">Board</span> under this article concerning a <span class="dictionary">land-disturbing activity</span> in a locality subject to the Chesapeake Bay Preservation Act (&#xA7;&#xA0;<a class="law" title="Cooperative state-local program" href="/62.1-44.15_67/">62.1-44.15:67</a> et seq.), or any <span class="dictionary">person</span> who has participated, in <span class="dictionary">person</span> or by submittal of written comments, in the public comment process related to such decision of the <span class="dictionary">Board</span> under this article, whether such decision is affirmative or negative, is entitled to judicial review thereof in accordance with &#xA7;&#xA0;<a class="law" title="Judicial review" href="/62.1-44.29/">62.1-44.29</a>. <span class="dictionary">Appeals</span> of other final decisions of the <span class="dictionary">Board</span> under this article shall be subject to judicial review in accordance with the provisions of the Administrative Process Act (&#xA7;&#xA0;<a class="law" title="Short title; purpose" href="/2.2-4000/">2.2-4000</a> et seq.).
		A final decision by a locality, when serving as a <span class="dictionary">VESMP authority</span>, shall be subject to judicial review, provided that an <span class="dictionary">appeal</span> is filed in the appropriate <span class="dictionary">court</span> within 30 days from the date of any written decision adversely affecting the rights, duties, or <span class="dictionary">privileges</span> of the <span class="dictionary">person</span> engaging in or proposing to engage in a <span class="dictionary">land-disturbing activity</span>.</p></section></text><history>1989, cc. 467, 499, &#xA7; 10.1-603.13; 2004, c. 372; 2012, cc. 785, 819; 2013, cc. 756, 793; 2014, cc. 303, 598; 2016, cc. 68, 758.</history><metadata></metadata></law>
