						<section><p>Each locality subject to an MS4 <span class="dictionary">permit</span> shall adopt an <span class="dictionary">ordinance</span> to implement a <span class="dictionary"><span class="dictionary">municipal separate storm sewer</span> system management program</span> that is consistent with this chapter and that contains provisions as required to comply with an MS4 <span class="dictionary">permit</span>. Such locality may utilize the civil <span class="dictionary">penalty</span> provisions in <span class="dictionary">subdivision</span> A 2 of &#xA7;&#xA0;<a class="law" title="Penalties, injunctions, and other legal actions" href="/62.1-44.15_48/">62.1-44.15:48</a>, the injunctive authority as provided for in subsection C of &#xA7;&#xA0;<a class="law" title="Penalties, injunctions, and other legal actions" href="/62.1-44.15_48/">62.1-44.15:48</a>, the civil charges as authorized in &#xA7;&#xA0;<a class="law" title="Additional local authority" href="/62.1-44.15_25.1/">62.1-44.15:25.1</a>, and the criminal provisions in &#xA7;&#xA0;<a class="law" title="Penalties" href="/62.1-44.32/">62.1-44.32</a>, to enforce the <span class="dictionary">ordinance</span>. At the request of another MS4, the locality may apply the penalties provided for in this section to direct or indirect discharges to any MS4 located within its <span class="dictionary">jurisdiction</span>.</p></section></text><history>2008, c. 13, &#xA7; 10.1-603.14:1; 2012, cc. 785, 819; 2013, cc. 756, 793; 2016, cc. 68, 758.</history><metadata></metadata></law>
