						<section><p>The <span class="dictionary">Department</span> shall require, if feasible and consistent with guidelines established by the <span class="dictionary">Department</span>, that the <span class="dictionary">noncustodial parent</span> post security or <span class="dictionary">bond</span> or give some guarantee to secure overdue payments. Advance notice shall be sent to the <span class="dictionary">noncustodial parent</span> setting forth (i) the amount of the delinquency, (ii) the proposed action to be taken by the <span class="dictionary">Department</span>, (iii) the method available for contesting the impending action and (iv) that only a &#x201C;<span class="dictionary">mistake of fact</span>&#x201D; as defined in &#xA7;&#xA0;<a class="law" title="Definitions" href="/63.2-1900/">63.2-1900</a> may be contested.</p></section></text><history>1986, c. 594, &#xA7; 63.1-250.4; 1988, c. 906; 2002, c. 747.</history><metadata></metadata></law>
