ORGANIZATIONS GOVERNING PUBLIC SCHOOL INTERSCHOLASTIC PROGRAMS; PARTICIPATION BY
STUDENTS IN MILITARY FAMILIES (§ 22.1-5.1)

A. No public elementary or secondary school shall become a member of any
organization or entity whose purpose is to regulate or govern interscholastic
programs that does not deem eligible for participation a student who:

   1. Previously attended the school and (i) moved with a parent, as defined in
   &#xA7; 22.1-1, out of the school&#8217;s attendance area because that parent
   is a full-time active duty member of the uniformed services of the United
   States, including service in the National Guard and Reserve on active duty
   orders pursuant to 10 U.S.C. &#xA7;&#xA7; 1209 and 1211, and received orders
   to relocate and (ii) moved back to and currently lives in the school&#8217;s
   attendance area; or

   2. Continues to live in the school&#8217;s attendance area, but whose parent,
   as defined in &#xA7; 22.1-1, moved out of the school&#8217;s attendance area
   because that parent is a full-time active duty member of the uniformed
   services of the United States, including service in the National Guard and
   Reserve on active duty orders pursuant to 10 U.S.C. &#xA7;&#xA7; 1209 and
   1211, and received orders to relocate.

B. Nothing in this section shall affect the school board&#8217;s discretion to
admit a student to a public school in the local school division and charge
tuition for his attendance if the student is not deemed to reside in the local
school division pursuant to &#xA7;&#xA7; 22.1-3 and 22.1-5.
