GUARANTY BY SELLER (§ 3.2-4007)

A. Any person who sells seeds for producing crops shall be bound as guarantor
that such seeds are true to kind and variety as represented at the time of sale.
If such seeds are sold by an agent, the principal shall be bound by the
representations of the agent with regard to the kind and variety of the seed.

B. Any person that sells seed for planting in a container that bears printed or
written statements regarding the kind, variety, or quality of the seeds therein
shall be bound as guarantor that such statement is accurate unless the seller
affirmatively proves the existence of a contrary agreement between the parties.
