COMMITMENT HEARINGS FOR INVOLUNTARY ADMISSIONS; DATA SHARING (§ 37.2-308.01)

Notwithstanding the provisions of §§ 16.1-305 and 37.2-818, at the request of
the Department and as provided in this section, the Office of the Executive
Secretary of the Supreme Court shall provide to the Department electronic data,
including individually identifiable information, on the proceedings provided for
in Article 16 (§ 16.1-335 et seq.) of Chapter 11 of Title 16.1 and Chapter 8
(§ 37.2-800 et seq.). For the purposes of this section, &#8220;individually
identifiable information&#8221; shall include the name and date of birth of the
individual who is the subject of the proceeding and the last four digits of the
individual&#8217;s social security number.
		Electronic data collected by the Department pursuant to this section may be
used by the Department for the purposes of developing and maintaining
statistical archives, conducting research on the outcome of proceedings provided
for in Article 16 (§ 16.1-335 et seq.) of Chapter 11 of Title 16.1 and Chapter
8 (§ 37.2-800 et seq.), and preparing analyses and reports for use by the
Department.
		The Department shall take all necessary steps to protect the security and
privacy of the electronic data to the same extent required by state and federal
law and regulations governing health information privacy. Such electronic data
shall not be subject to the Virginia Freedom of Information Act (§ 2.2-3700 et
seq.).
