EXAMINATION REPORTS; GENERAL DESCRIPTION (§ 38.2-1320)

The Commission&#8217;s examiners shall make a true report of every examination.
The report shall include only facts appearing upon the books, records or other
documents of the person examined or as ascertained from the sworn testimony of
its directors, officers, employees, agents or other persons examined concerning
its affairs and any conclusions and recommendations reasonably warranted from
such facts. Findings of fact and conclusions made pursuant to any examination,
and reported in any filed examination report for which the period for appeal has
expired, shall be prima facie evidence in any subsequent legal or regulatory
action.
