CERTIFICATION TO ACCOMPANY APPLICATION (§ 38.2-3402)

A. Each application for an individual accident and sickness insurance policy
shall contain a certification, signed by both the applicant and the agent
soliciting the insurance, to the effect that: &#8220;The undersigned applicant
and agent certify that the applicant has read, or had read to him, the completed
application and that the applicant realizes that any false statement or
misrepresentation in the application may result in loss of coverage under the
policy.&#8221; If the application is to be used in a solicitation where no agent
is involved, the certification may delete the reference to and signature of the
agent soliciting the insurance.

B. Subsection A of this section shall also apply to an application by an
individual for coverage under a group policy where individual underwriting is
done.

C. If the certification is wholly or partially inapplicable to a particular form
of policy, the insurer may modify or omit the certification with the approval of
the Commission.
