COVERAGE OF PREEXISTING CONDITIONS (§ 38.2-3520)

A. Notwithstanding the provisions of § 38.2-3503, if an insurer elects to
use a simplified application form, with or without a specific question as to the

insured’s health history or medical treatment history, the policy shall
cover any loss occurring after twelve months from the effective date of coverage
from any preexisting condition not specifically excluded from coverage by terms
of the policy. Except as so provided, the policy shall not include wording that
would permit a defense based upon preexisting conditions.

B. The provisions of this section shall not apply in any instance in which the
provisions of this section are inconsistent or in conflict with a provision of
Article 6 (§ 38.2-3438 et seq.) of Chapter 34.
