CREDITS AGAINST MALPRACTICE INSURANCE PREMIUMS (§ 38.2-5020.1)

A. Each insurer issuing or issuing for delivery in the Commonwealth any personal
injury liability policy which provides medical malpractice liability coverage
for the obstetrical practice of any participating physician under this chapter
shall provide a credit on such physician&#8217;s annual medical malpractice
liability insurance premium in an amount that will produce premiums that are
neither inadequate, excessive nor unfairly discriminatory, as required by &#xA7;
38.2-1904, and as determined by the Commission.

B. Each insurer issuing or issuing for delivery in the Commonwealth any personal
injury liability policy which provides medical malpractice liability coverage
for the obstetrical services of any participating hospital under this chapter
shall provide a credit on such hospital&#8217;s annual medical malpractice
liability insurance premium in an amount that will produce premiums that are
neither inadequate, excessive nor unfairly discriminatory, as required by &#xA7;
38.2-1904, and as determined by the Commission.
