EXAMINATIONS (§ 38.2-5808)

A. In lieu of or in addition to making its own examination of an MCHIP and its
health carrier, the Commission may accept the report of an examination of the
health carrier or other person responsible for the MCHIP under the laws of
another state certified by the insurance supervisory official, similar
regulatory agency, or the state health commissioner of another state.

B. The Commission shall coordinate examinations of an MCHIP and its health
carrier with the State Health Commissioner&#8217;s examination or review of the
health carrier to ensure an appropriate level of regulatory oversight and to
avoid any undue duplication of effort or regulation.

C. The Commission shall accept a current certificate of quality assurance issued
by the Department of Health as evidence of compliance by the certificate holder
with any provision in this chapter authorizing or requiring assessment by the
Department of Health, by the State Health Commissioner, or pursuant to
regulations promulgated by the State Health Commissioner.
