LIABILITY OF BOARD MEMBERS; SUITS BY AND AGAINST BOARD (§ 4.1-625)

A. No Board member may be sued civilly for doing or omitting to do any act in
the performance of his duties as prescribed by this subtitle, except by the
Commonwealth, and then only in the Circuit Court of the City of Richmond. Such
proceedings by the Commonwealth shall be instituted and conducted by the
Attorney General.

B. The Board may, in the name of the Commonwealth, be sued in the Circuit Court
of the City of Richmond to enforce any contract made by it or to recover damages
for any breach thereof. The Board may defend the proceedings and may institute
proceedings in any court. No such proceedings shall be taken against, or in the
names of, the members of the Board.
