AUTHORITY OF COORDINATOR OF EMERGENCY MANAGEMENT IN UNDECLARED EMERGENCY (§
44-146.18:2)

In an emergency which does not warrant a gubernatorial declaration of a state of
emergency, the Coordinator of Emergency Management, after consultation with and
approval of the Secretary of Public Safety and Homeland Security, may enter into
contracts and incur obligations necessary to prevent or alleviate damage, loss,
hardship, or suffering caused by such emergency and to protect the health and
safety of persons and property. In exercising the powers vested by this section,
the Coordinator may proceed without regard to normal procedures pertaining to
entering into contracts, incurring of obligations, rental of equipment, purchase
of supplies and materials, and expenditure of public funds; however, mandatory
constitutional requirements shall not be disregarded.
