VALIDATION OF CONVEYANCES OF REAL PROPERTY UNDER TRUST INSTRUMENT NOT
AUTHORIZING SALE (§ 55.1-328)

When any real property is conveyed by deed of trust or other trust instrument to
a trustee and there is no provision authorizing the trustee to convey the
property that is the subject of the deed of trust, or any part of such property,
and the trustee conveys such property or any part of such property, such
conveyance shall be valid after a period of 30 years from the date of such
conveyance, provided that (i) there have been no adverse claims against the
property so conveyed in the interim, and (ii) such conveyances to and from such
trustee were properly recorded and indexed at the time of the conveyance, in the
appropriate clerk&#8217;s office in which deeds are recorded in the county or
city in which the property lies.
