§ 46.2-731 Disabled parking license plates; owners of vehicles specially equipped and used to transport persons with disabilities; fees

On receipt of an application, the Commissioner shall issue appropriately designed disabled parking license plates to persons with physical disabilities that limit or impair their ability to walk or that create a concern for his safety while walking or to the parents or legal guardians of such persons. The Commissioner shall request that the application be accompanied by a certification signed by a licensed physician, licensed podiatrist, licensed chiropractor, licensed advanced practice registered nurse, or licensed physician assistant that the applicant meets the definition of “person with a disability that limits or impairs his ability to walk” contained in § 46.2-1240. The issuance of a disabled parking license plate shall not preclude the issuance of a permanent removable windshield placard. On application of an organization, the Commissioner shall issue disabled parking license plates for vehicles registered in the applicant’s name if the vehicles are primarily used to transport persons with disabilities. The application shall include a certification by the applicant, under criteria determined by the Commissioner, that the vehicle is primarily used to transport persons with disabilities that limit or impair their ability to walk, as defined in § 46.2-1240. The fee for the issuance of a disabled parking license plate under this section may not exceed the fee charged for a similar license plate for the same class vehicle.

History

This law was first created in 1972. The record of its establishment is cataloged in chapter 473 of that year’s edition of “Acts of Assembly,” the annual state publication listing all changes made to the Code of Virginia in that year. Unfortunately, the 1972 “Acts” aren’t available online. It has been modified 15 times. Those modifications are cataloged by “The Acts of Assembly,” a state publication, by year and chapter. Those modifications that can be read on the General Assembly’s website will be linked accordingly. Those modifications are as follows: in 1973, chapter 182; in 1974, chapters 46 and 410; in 1976, chapters 410 and 460; in 1978, chapters 185 and 605; in 1982, chapter 88; in 1983, chapter 38; in 1986, chapter 144; in 1989, chapter 727; in 1993, chapter 566; in 1994, chapters 225 and 866; in 1995, chapters 776 and 805; in 1997, chapters 783 and 904; in 2004, chapter 692; in 2007, chapter 715; in 2023, chapter 183.
